    Where a couple intends to divorce voluntarily, they shall sign a written divorce agreement and jointly submit an application for divorce registration in person to the marriage registration authority. Within 30 days of the date on which the marriage registration authority receives the application, either party may withdraw the application. Within 30 days upon the expiration of the aforesaid period, both parties shall apply in person to the marriage registration authority for divorce certificates. Failure to file such an application shall be deemed a withdrawal of the divorce registration application.一、Acceptance Conditions for Divorce Registration(一)The marriage registration authority shall perform its statutory duties;(二)Both parties who plan to divorce shall jointly arrive at the Marriage Registration Office of Civil Affairs Bureau in person to apply for registration;(三)Both parties have full capacity for civil conduct;(四)The applicants hold a divorce agreement that clearly states their voluntary intention to divorce and contains a consensus reached through consultation on child support, property disposition, debt settlement, and other related matters.(五)The applicants hold marriage certificates issued by mainland marriage registration authorities or Chinese embassies and consulates abroad;(六)The parties shall possess the prescribed valid identity documents and written documents;二、Procedures for Divorce Registration(一)Application:Couples seeking a voluntary divorce shall sign a written divorce agreement, submit the application,together with valid documents and written materials,to the marriage registration authority, and completethe Application for Divorce Registration on site.(二)Acceptance: The marriage registration authority shall examine the documents and written materials submitted by the applicants and interview them separately. Applications that complywith the relevant requirements shall be accepted,and a Receipt for Accepted Divorce Registration Application shall be issued. Those failing to meet the requirements shall be rejected. Where an applicant requests a Notice of Rejected Divorce Registration Application, the authority shall issue such a notice.(三)30-day Period:Within 30 days after receiving the Receipt for Accepted Divorce Registration Application (the period shall commence on the day following the receipt of the application. If the last day of the period falls on a statutory holiday, the next working day after the holiday shall be deemed the last day of the period. Either party who no longer wishes to divorce may withdraw the application by presenting their valid identity document and the aforesaid receipt, and filling out the Application for Withdrawal of Divorce Registration Application in person. Upon verification, the marriage registration authority shall issue a Confirmation of Withdrawal of Divorce Registration Application. Within 30 days upon the expiration of the above period (the period shall commence on the day following the expiry date. If the last day of the period falls on a statutory holiday, the next working day after the holiday shall be deemed the last day of the period. Failure of both parties to apply together for divorce certificates shall be deemed a withdrawal of the divorce registration application.(四)Review: Within 30 days upon the expiration of the aforesaid period (the period shall commence on the day following the expiry date. If the last day of the period falls on a statutory holiday, the next working day after the holiday shall be deemed the last day of the period. Both parties shall go through divorce registration formalities at the marriage registration authority with the prescribed valid documents and certificates. The authority shall verify the submitted documents and materials and conduct interviews. Where it is confirmed that the divorce is voluntary and the parties have reached full agreement on child support, property disposition and debt settlement. Both parties apply in person for divorce certificates, and the authority shall complete the registration on the spot. Applications that do not comply with divorce registration requirements shall be rejected. Where an applicant requests a Notice of Refusal to Handle Divorce Registration, the authority shall issue such a notice.(五)Registration and Certificate Issuance: The marriage registration authority shall issue divorce certificates in accordance with applicable laws and regulations.三、Documents Submitted for Divorce Registration(一) Marriage certificates issued by mainland marriage registration authorities or Chinese embassies and consulates abroad.(二) A divorce agreement stating the parties’ voluntary intention to divorce and consensus on child support, property disposition, debt settlement and other related matters.(三)Valid identity documents and written materials.Mainland residents: Present a valid Resident Identity Card. Those unable to submit identity cards for special reasons may present valid temporary resident identity cards.Hong Kong residents: Valid Mainland Travel Permit for Hong Kong Residents or Hong Kong Residence Permit, together with Hong Kong Identity Card.Macao residents: Valid Mainland Travel Permit for Macao Residents or Macao Residence Permit, together with Macao Identity Card.Taiwan residents: Valid Mainland Travel Permit for Taiwan Residents, Taiwan Residence Permit, or other valid travel documents, together with a valid identity document issued in the Taiwan Region.Overseas Chinese: Valid passports.Foreign nationals: Valid passports or other valid international travel documents, or identity documents issued by competent Chinese authorities, such as the Foreign Permanent Resident Identity Card. Alternatively: A valid passport of the applicant, as well as the certificate issued by the Embassy or Consulate of the People's Republic of China in the said country proving the aforesaid marital status and kinship status, accompanied by its Chinese translation. (Contracting States refer to countries that have acceded to the Convention Abolishing the Requirement of Legalization for Foreign Public Documents. For the latest list of Contracting States and the entry-into-force status of the Convention, please log on to the website of the Chinese Consular Service Network (http://cs.mfa.gov.cn). The same shall apply hereinafter.)Overseas Chinese residing in non-Contracting States: A valid passport of the applicant; a certificate issued by a notarial institution or competent authority of the residence country, authenticated by the Embassy or Consulate of the People's Republic of China in that country, certifying that the applicant has no spouse and shares no lineal consanguinity or collateral consanguinity within three generations with the other party, together with its Chinese translation. Alternatively: A valid passport of the applicant, plus a certificate issued by the Embassy or Consulate of the People's Republic of China in that country verifying the aforesaid marital status and kinship status, accompanied by its Chinese translation.Relevant certificates issued by countries having no diplomatic relations with China shall be authenticated by the embassy or consulate of a third country which maintains diplomatic relations with both such country and China, stationed in the aforesaid country and by the Chinese embassy or consulate stationed in that third country, or authenticated by the embassy or consulate of the said third country stationed in China.Foreign nationals from Contracting States: A valid passport or other valid international travel documents of the applicant, or identity documents issued by the competent authorities of the Chinese government, such as the Foreign Permanent Resident Identity Card. (Where the applicant uses the Foreign Permanent Resident Identity Card as an identity document, the valid passport number shall be provided simultaneously); a single status certificate issued by the notarial institution or competent authority of the home country, together with an apostille and its Chinese translation. Alternatively: A valid passport or other valid international travel documents, or identity documents issued by the competent authorities of the Chinese government, including the Foreign Permanent Resident Identity Card. (Applicants using the Foreign Permanent Resident Identity Card shall also furnish their valid passport numbers), alongside a single status certificate issued by the embassy or consulate of the home country stationed in China, together with its Chinese translation.Foreign Nationals from Non-Contracting States: A valid passport or other valid international travel documents of the applicant, or identity documents issued by competent authorities of the Chinese government, such as the Foreign Permanent Resident Identity Card. (If the applicant uses the Foreign Permanent Resident Identity Card as an identity credential, the valid passport number shall be submitted concurrently); a single status certificate issued by a notarial institution or competent authority of the home country, duly authenticated by the Embassy or Consulate of the People's Republic of China in that country or by the embassy or consulate of that country in China, together with its Chinese translation. Alternatively: A valid passport or other valid international travel documents, or identity documents issued by competent authorities of the Chinese government, including the Foreign Permanent Resident Identity Card. (Applicants adopting the Foreign Permanent Resident Identity Card shall provide their valid passport numbers as well), accompanied by a single status certificate issued by the embassy or consulate of the home country in China and its Chinese translation.Relevant certificates issued by countries without diplomatic relations with China shall be authenticated by the embassy or consulate of a third country having diplomatic relations with both the issuing country and China, accredited to the issuing country and by the Chinese diplomatic or consular mission in such third country, or authenticated by the embassy or consulate of the aforesaid third country stationed in China.
